Here at Digjack we appreciate the importance of protecting your personal information. This Privacy Policy tells you about the information we collect from you when you use any website or mobile application owned or operated by Digjack (including Digjack websites around the world: collectively, the “Site”). It describes our practices for collecting, using, maintaining, protecting, and disclosing that information.  This policy applies to information we collect: on this Site; email, text, and other electronic messages between you and this Site; through mobile and desktop applications you download from this Site, which provide dedicated non-browser-based interaction between you and this Site; and when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Privacy Policy. This Privacy Policy does not apply to information collected by:  us offline or through any means, including on any other website operated by us or a third party; or any third party, including through any application or content (including advertising) that may link to or be accessible from the Site.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it.  By using our services, and the Site, you understand and expressly agree to Digjack collecting, storing, processing, and sharing your information as described in this Privacy Policy. This policy is not a contract between Digjack and its users, but rather a notification of the Digjack policies. If you do not agree with our policies and practices, do not use the Site.  This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Your personal information

Digjack collects your name, email address, and other personal information that you voluntarily provide to us when you: sign up for a Digjack Shop or register as a Digjack user; send us email; make a purchase or make an offer to a Digjack Shop; contact a Digjack Shop; enter a competition or other promotion sponsored by Digjack and/or our third-party partners; or anytime that you contact Digjack, including when you report a problem with the Site.

Digjack retains the personal data collected from you for only as long as your account is active or for a limited period of time as long as we need it to fulfill the purpose for which the data was initially collected, unless otherwise necessary for our legitimate business interests, to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with investigations, enforce the terms of service and take other actions permitted by law. The information retained will be handled in accordance with this Privacy Policy and will not be held for longer than is reasonably necessary.

How we use your personal information

Digjack uses your personal information in the normal course of our business to provide the products and services you have requested. We also use this information to provide positive identification of you when you contact us. On occasion, we also send you notices, statements and email updates on Digjack services and other materials we believe may be of importance or interest to you.

Digjack also uses personal information to provide you, the user, with a personalized web experience when visiting our site. By knowing a little about you, Digjack is able to deliver more relevant content and thus a better service, to you.

Digjack may also use personal information to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

Digjack may also use personal information in any other way we may describe when you provide the information or for any other purpose with your consent.

Making a purchase from a Digjack Shop

If you purchase or make offers in a Digjack Shop, we may collect personal information which will be used by the Shop owner to complete the transaction. Digjack is only a venue and does not own the Shops, however, as part of the buying and selling process, we facilitate the sharing of information between the Shop owner and buyer involved in the transaction, such as the buyer’s shipping address and payment information. By making a sale or a purchase on Digjack, you are directing us to share your information in this way. You are not required to have a Digjack account to place an order. You may place an order either through your account or through guest checkout.  If you choose to use guest checkout, you will be given the option to create an account, but creating an account is not required. If you choose to use guest checkout, the information that you provide in order to process your purchase will not be stored by Digjack (with the exception of automatically collected information, as described in this Privacy Policy).

Payment Processing

When you make a purchase, we may collect information about the products you purchase, shipping and delivery information and information related to returns, refunds and cancellations. We may also collect and store limited payment information from you, such as payment card type and expiration date and the last four digits of your payment card number; however, we do not collect or store full payment card numbers.

We use a third-party payment processor, Stripe, to process payments. In connection with the processing of such payments, we do not retain any personally identifiable information or any financial information such as credit card numbers. Rather, all such information is provided directly to Stripe. Stripe’s use of your personal information is governed by their privacy policy, which is available at Stripe Privacy Policy


Disclosure of personal information 

Digjack will not disclose any of your personal information, except as described below, or when we believe in good faith that the law requires it, or to protect the rights or property of Digjack.

Digjack may disclose personal information, but only when it is clearly stated at the time we ask for the information, such as during registration, or in the rules of a competition or other promotion.

If you contact a Digjack Shop owner, make an offer or make a purchase through the Site, the information that you provide will be shared with the owner of that Shop so they can respond or process the transaction. These Shop Owners have their own separate privacy and data collection policies independent of Digjack, and Digjack has no responsibility or liability in connection with these.

Digjack may share or disclose your personal information at your direction or request, or upon your consent, such as when you authorize a third-party application to access your account or when you direct us to share your feedback with a Digjack Shop owner or other business.

Digjack may also share disclose your personal information with other Digjack partners, such as Internet sites and services accessible through Digjack or parties whom we inform you are collecting data in connection with competitions or other promotions, have their own, separate privacy and data collection practices independent of Digjack, and Digjack has no responsibility or liability in connection with these.

Digjack may also disclose your personal information to our subsidiaries and affiliates; to contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them; to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Digjack’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Digjack about our Site users is among the assets transferred.

Service Providers

Digjack may employ third-party companies to perform other functions on our behalf. These functions may include, though not exclusively, order fulfillment, package delivery, marketing assistance, postal and e-mail delivery, customer service, data analysis, and credit processing (see Payment Processing). The third parties we contract for these purposes have limited access to your personal information and may not use it for other purposes.

Information We Collect Through Automatic Data Collection Technologies

Testimonial/Feedback about our Services

By posting your testimonial/feedback on the Site, you give us permission to reprint or use the testimonial/feedback in connection with our business. You also are agreeing to the following: The reprint or use of the testimonial/feedback will be at our discretion and without compensation; we may use the testimonial/feedback with or without any pseudo (pen) name credit; our right to use the testimonial/feedback is perpetual and may be assigned by us; we may use the testimonial/feedback locally, nationally or globally and such use may be made in any media, information or communication platform (including Internet advertising) currently in use or later developed; and You and not someone else composed and posted the testimonial/feedback.  

Please note that any information you include in a testimonial/feedback may be read, collected, and used by anyone.  Your testimonial/feedback is posted on and transmitted to others at your own risk. Testimonial/Reviews about Products

The testimonial/reviews sections of the Site are for the purpose of sharing positive experiences and product reviews. The testimonial/reviews sections are moderated to ensure accurate testimonial/reviews. Published testimonial/reviews are genuine and are not edited or altered by Digjack. Digjack reserves the right to post or remove any testimonial/reviews at its discretion.

We (Digjack)  maintain a presence on social media platforms including, but not limited to, Facebook, Twitter, Instagram, and YouTube. Any information you post on any Digjack social media pages is done at your own risk and without any expectation of privacy. Please be aware that Digjack is not responsible for the privacy practices of such other sites and you should review each sites own policy.

Retention

Digjack will retain your information only for as long as is necessary for the purposes set out in this Privacy Policy, for as long as your account is active, as described in this policy, or as needed to provide the Site’s services to you. If you no longer want Digjack to use your information, you may close your account. Digjack will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. We also retain log files for internal analysis purposes. These log files are generally retained for a brief period of time, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for longer time periods.

Your Rights

You may benefit from a number of rights in relation to your information that we process. Some rights apply only in certain limited cases, depending on your location. Upon request, Digjack will provide you with information about whether we hold any of your personal information.  By visiting your account settings, you can access, correct, change, and delete certain personal information associated with your account. In certain cases where we process your information, you may also have a right to restrict or limit the ways in which we use your personal information. In certain circumstances, you also have the right to request the deletion of your personal information, and to obtain a copy of your personal information in an easily accessible format. If we process your information based on our legitimate interests as explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your personal data for direct marketing purposes, you can always object using the unsubscribe link in such communications or changing your account settings. Please note that some changes to your account settings may take a few days to take effect.

Security

Digjack takes precautions to protect your information. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. [We urge you to be careful about giving out information in public areas of the Site like message boards. Unfortunately, the transmission of information via the internet is not completely secure. Children

Digjack is committed to protecting the welfare and privacy of children. All listings are sold for purchase by adults only. If you are under the legal age of majority in your jurisdiction, you may only use the Site in the presence of a consenting parent or guardian. The Site is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Site or on or through any of its features/register on the Site, make any purchases through the Site, use any of the interactive or public comment features of the Site or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Changing personal information

You can change your personal information by signing in, going to My Account, and selecting the information you wish to edit.  If you delete your feedback, reviews, and/or testimonials from the Site, copies of such submissions may remain viewable in cached and archived pages, or might have been copied or stored by other Site users. Proper access and use of information provided on the Site is governed by our terms of use 

Changes to the Digjack Privacy Policy
